Steven Blackerby successfully defended a restaurant in a lawsuit alleging that a defective handicap ramp had caused the plaintiff to trip and fall. Despite evidence that the ramp did not comply with building codes and that it deviated from the restaurant’s construction plans, the Court of Appeals agreed with Steven that the plaintiff was barred from recovering because the ramp was open and obvious and because the plaintiff had previously used the ramp.
